Welcome to Tapy, a mobile platform owned and operated by Tapy Pty Ltd (ACN 632 037 131). This document outlines our Terms of Use and Privacy Policy, which govern your use of our mobile applications (available on the App Store and Google Play Store), website (www.tapy.co), and related services (“Tapy”, “we”, “us”, or “our”).
By accessing or using Tapy, you agree to these Terms and our Privacy Policy. If you do not agree, you must not use the Tapy App or services.
1. Who We Are
Tapy is a discovery and engagement engine that connects users, businesses, and influencers. Businesses can post promotions, offers, exclusives, or services—known in the app as Taps—which users can explore, redeem, or share. Tapy facilitates referral tracking, payment handling, and campaign performance.
2. Eligibility
You must:
Be at least 16 years old to use the app.
If under 18, have permission from a parent or guardian.
Reside in and comply with local laws in Australia or New Zealand, including:
New Zealand: Privacy Act 2020, Financial Markets Conduct Act 2013, Fair Trading Act 1986
Australia: Privacy Act 1988 (Cth), Australian Consumer Law
3. Your Account
You are responsible for:
Maintaining the confidentiality of your account details.
Notifying us at hello@tapy.co if you suspect unauthorised access.
All activity that occurs under your account.
4. Payments, Taps, and Referral Earnings
A. Payments for Products and Services (Taps)
Businesses may promote offers, exclusives, or services via the app—known as Taps. When a user redeems or purchases a Tap:
Stripe securely processes the payment.
Funds go directly to the business offering the Tap.
Tapy acts as a payment facilitator and does not hold funds beyond the required transaction period.
Tap Fees (for Businesses)
Tapy charges the following to businesses for Tap facilitation:
Redemption Fees (only charged if a Tap is redeemed):
$0.25 AUD/NZD per Tap under $7.50
$0.60 AUD/NZD per Tap over $7.50
Transaction & Surcharge Fees:
Business surcharge:
2.2% per transaction in Australia
2.8% per transaction in New Zealand
User surcharge (passed to the customer):
2.2% per transaction in both Australia & New Zealand
B. Referral Commissions
Eligible users and influencers may earn commissions by referring users or businesses to the platform, App and create content and share on other platforms to promote Tapy, reviews of a business or any content relating to their profile or promoted Tap. These earnings:
Are tracked via referral codes or links.
Are disbursed after verification.
Must comply with platform rules and laws.
Tapy may withhold or reverse earnings in cases of fraud, abuse, or misrepresentation. Commissions are subject to local tax laws and reporting obligations.
5. Use of the Platform
You agree not to:
Violate any applicable laws or regulations in Australia, New Zealand, or your jurisdiction.
Misrepresent or spam referrals.
Upload or distribute content that infringes others’ rights.
Scrape, harvest, or mine data from the app.
Circumvent or reverse-engineer Tapy’s systems or security.
Collect or share personal information without valid consent.
Violation of these terms may result in account suspension, termination, and legal action.
6. Intellectual Property
All content, branding, tools, and code on Tapy are the exclusive property of Tapy Pty Ltd or its licensors. You may not copy, replicate, or distribute any part of the platform without written consent.
7. App Store and Google Play Compliance
You must comply with:

Tapy may auto-update and may include third-party components governed by their own licenses.
8. Disclaimers and Limitations
Tapy provides services “as-is” without guarantees. We are not responsible for:
Losses arising from use or inability to use the app.
Missed commissions or transaction delays.
Indirect or consequential damages, to the fullest extent permitted by law.
9. Termination of Service
We may suspend or terminate your account if:
You breach these Terms
You engage in fraudulent, unlawful, or abusive behavior
You misuse referral or payment systems
10. Privacy Policy
Tapy is committed to protecting your personal information in line with:
Australia’s Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs)
New Zealand’s Privacy Act 2020
What We Collect
We may collect:
Name, email, phone number
Login credentials and usage data
Device information and location (with consent)
Payment and referral history
Business or influencer campaign activity
How We Use Your Data
We use your information to:
Create and manage your account
Process payments and facilitate transactions
Connect users and businesses
Track and pay referral commissions
Communicate offers or updates (you may opt out anytime)
Improve Tapy's features and functionality
Data Storage and Security
Your data is stored on secure servers in:
Australia, New Zealand, and/or trusted global providers
We use encryption, access control, and compliance with data sovereignty laws to protect your information.
Sharing Your Data
We do not sell your data. We may share it with:
Businesses you’ve transacted with
Payment providers like Stripe
Platform operation vendors (under strict confidentiality)
Legal authorities when required by law
11. Your Rights
You have the right to:
Access your personal information
Correct inaccuracies
Request deletion of your data
Withdraw consent for communications

12. Third-Party Services
Tapy may integrate with third-party platforms (e.g. Stripe, Meta, Google). We are not responsible for their privacy practices. You should review their respective terms and policies separately.
13. Children’s Privacy
Tapy is not intended for users under 16 years of age. We do not knowingly collect data from minors. If you believe a child has registered without consent, please contact us.
14. Dispute Resolution
We aim to resolve any disputes in good faith. If unresolved, the matter will be submitted to mediation or arbitration under:
New South Wales law, if you reside in Australia
New Zealand law, if you reside in New Zealand
Both parties agree to keep dispute proceedings confidential.
15. Changes to Terms and Policy
We may update these Terms and Privacy Policy at any time:
Changes will be posted in-app or on www.tapy.co
Major changes may be notified via email or push notifications
Continued use of the app after changes constitutes acceptance of the updated terms.
